I, the undersigned participant, hereby acknowledges and agrees to the following terms and conditions in consideration for being permitted to participate in guided hiking and snowshoeing tours (the "Activity") organized by SLOW DOWN TOURS (the "Releasee"):

1. Certification of Physical Capability and Fitness

I certify that I am physically capable and fit to participate in the Activity, and I confirm that I do not have any existing medical conditions that may pose a higher risk for participation. I further confirm that it is my responsibility to consult with a medical professional prior to participating in the Activity if I have any concerns regarding my physical condition.

2. Assumption of Risks

I understand and acknowledge that the Activity involves strenuous activities and many inherent risks, dangers, and hazards, including but not limited to: 

1. risks associated with hiking, walking on uneven terrain and changing terrain conditions;

2. exposure to unstable and unpredictable weather conditions;

3. encounters with unpredictable and potentially dangerous domestic or wild animals;

4. risk of injury or death due to accidents or acts of nature; 

5. negligence on the part of other participants; 

6. negligence on the part of the Releasees, including the failure on the part of the Releasees to safeguard or protect me from the risks, dangers and hazards of participating in the Activities,

and I voluntarily assume all risks associated with the Activity.

3. Release of Liability

I hereby release, waive, discharge, and covenant not to sue the Releasee, its officers, directors, employees, guides, and agents from any and all claims, liabilities, demands, actions, or causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by me or to any property belonging to me, whether caused by the negligence of the Releasee or otherwise, while participating in the Activity. This release of liability shall apply to all claims, regardless of whether they arise out of the negligence, gross negligence, or other fault of the Releasee.

4. Indemnification

I agree to indemnify, defend, and hold harmless the Releasee, its officers, directors, employees, guides, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable legal fees and disbursements) arising out of or related to my participation in the Activity. This indemnification obligation shall apply to any claims brought by third parties, including but not limited to claims brought by other participants or by my family members, executors, administrators, heirs, or representatives.

5. Responsibility for Safety

I agree to govern myself in a manner that ensures my own safety during the Activity. I understand and acknowledge that the Releasee may provide instructions or guidelines, but it is ultimately my responsibility to follow these instructions and to act in a safe and responsible manner at all times during the Activity.

6. No Reliance on Representations

I acknowledge that I am not relying on any representations, warranties, or guarantees made by the Releasee regarding the safety or suitability of the Activity. I understand that the Releasee may provide information about the Activity, but I agree that I am solely responsible for assessing the risks and deciding whether to participate.

7. Medical Authorization

I authorize the Releasee and its representatives to secure medical treatment for me in the event of any injury or medical emergency during my participation in the Activity. I understand that the Releasee may not have medical professionals on staff and that any medical treatment provided will be based on the available resources and circumstances.

8. Privacy of Personal Information

The Releasee will keep the personal information provided private and confidential and will not disclose it to third parties without your consent, except as required by law.

9. Communication via Email

I acknowledge and agree that the Releasee may contact me via email for purposes related to the Activity, including but not limited to requesting photos and reviews and providing updates, reminders, or other information relevant to my participation. 

10. Severability

If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall nevertheless continue in full force and effect. If any provisions are held to be invalid or unenforceable in part, the remaining portion of the provision shall remain in effect to the extent possible.

11. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of British Columbia, without regard to its conflicts of law provisions. Any dispute arising out of or related to this Agreement shall be resolved exclusively in the courts of British Columbia.

12. Acknowledgement

I confirm that I am the full age of 19 and that I have read this Agreement, understand its terms, and voluntarily sign it without any inducement or assurance of any nature.
